Terms of Service

These Terms of Service (the "Terms") set out the conditions for using YABAINE (the "Service"). By using the Service, you agree to these Terms.

1. The Service

The Service helps you create, save, or share content by adding effects, audio, and other elements in response to your interactions with photos and videos you select.

2. Your responsibilities

You use the Service at your own responsibility and confirm that you have the necessary rights or permissions for materials you select, post, or share.

3. Prohibited conduct

Violating laws, public order, or the rights of others.
Impersonating others or acting in a way that is misleading.
Accessing the Service or related systems without authorization, or interfering with their operation.
Using material that infringes copyright, likeness, privacy, or other rights of third parties.
Using the Service for unlawful or inappropriate purposes.

4. Content and intellectual property

Rights in photos, videos, and other material you provide remain with you or the applicable rights holder. Rights in the Service name, logo, interface, software, and Service-created materials remain with us or the applicable rights holder.

5. Third-party services

The Service may work with third-party services, including Google Photos Picker. Their terms and policies also apply when you use those services.

6. Changes or suspension

We may change, suspend, or discontinue all or part of the Service without prior notice where necessary for maintenance, outages, specification changes, or other operational reasons.

7. Disclaimers and limitation of liability

We do not guarantee the accuracy, completeness, continuity, or fitness for a particular purpose of the Service. To the extent permitted by law, we are not liable for damage related to use of the Service, except in cases of our intentional misconduct or gross negligence.

8. Changes to these Terms

We may update these Terms when necessary. We will provide notice through the Service for material changes.

9. Governing law and venue

These Terms are governed by the laws of Japan. Courts with jurisdiction under Japanese law have exclusive jurisdiction over disputes related to the Service.
